Terms of Service

Welcome to Jessalyn AI. These Terms of Service govern your access to and use of the Jessalyn AI application and all related services. By using Jessalyn AI, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are a parent or guardian consenting on behalf of a minor, these Terms apply to both you and your child.

Acceptance of Terms

By downloading, accessing, or using Jessalyn AI ("Jessalyn," "the App," "the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Jessalyn AI, Inc. If you do not agree to these Terms, you must not use the Service. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Your parent or guardian is responsible for your use of the Service and agrees to be bound by these Terms in connection with such use. We may update these Terms from time to time. If we make material changes, we will notify you through the App or via the email address associated with your account at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

What Jessalyn AI Is — and What It Is Not

Jessalyn AI is an artificial intelligence wellness companion designed to provide emotional support, self-reflection tools, and wellness resources. The Service includes text and voice conversations with an AI companion, guided meditations, daily intention setting, session summaries, and emotional wellness insights. JESSALYN AI IS NOT A MEDICAL DEVICE, HEALTHCARE PROVIDER, OR MENTAL HEALTH PROFESSIONAL. The Service does not provide medical advice, diagnosis, treatment, therapy, counseling, or any form of clinical care. Jessalyn is not a licensed therapist, psychologist, psychiatrist, social worker, or counselor. The AI companion does not have the ability to prescribe medication or make clinical assessments. The Service is not a substitute for professional mental health care. If you are experiencing symptoms of a mental health condition, you should consult a qualified healthcare provider. Do not disregard, avoid, or delay obtaining professional medical advice because of anything you have read or experienced through Jessalyn AI. Jessalyn AI is not appropriate for individuals experiencing acute psychiatric crises, active suicidal ideation with a plan or intent, severe eating disorders requiring medical monitoring, active substance withdrawal, psychotic episodes, or any condition requiring immediate clinical intervention.

Crisis & Emergency Services

JESSALYN AI IS NOT AN EMERGENCY SERVICE AND SHOULD NOT BE USED IN CRISIS SITUATIONS. If you or someone you know is in immediate danger or experiencing a medical or mental health emergency, please take the following steps immediately: Call 911 (or your local emergency number) if there is immediate danger to life. Contact the 988 Suicide & Crisis Lifeline by calling or texting 988 (available 24/7 in the United States). Text HOME to 741741 to reach the Crisis Text Line. Go to the nearest emergency room. While Jessalyn AI includes safety protocols designed to detect language that may indicate crisis or self-harm, these systems are not infallible. AI-based detection has inherent limitations and may fail to identify a crisis or may misinterpret conversational context. You should never rely on Jessalyn AI as your sole source of support during a mental health emergency. If the App detects indicators of crisis, it will surface relevant crisis resources within the conversation. This is an automated response and does not constitute clinical assessment or intervention. No human monitors conversations in real time.

Eligibility & Age Requirements

You must be at least 13 years of age to use Jessalyn AI. If you are under 13, you may not create an account or use the Service in any way. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information promptly. Users aged 13 to 17 ("Minor Users") must have the consent of a parent or legal guardian to use the Service. By creating an account for or consenting to your child's use of Jessalyn AI, you as a parent or guardian: (a) agree to these Terms on behalf of your child; (b) accept responsibility for your child's activity on the Service; (c) affirm that you have the legal authority to consent on behalf of your child; and (d) acknowledge that the Service is an AI wellness tool, not a substitute for professional care. We may require age verification during account registration. If we have reason to believe a user has misrepresented their age, we reserve the right to suspend or terminate the account. In jurisdictions where the minimum age for digital consent is higher than 13 (such as 16 in certain EU/EEA member states), the higher age applies. In compliance with applicable law, the App may provide periodic reminders to Minor Users during extended sessions, encouraging breaks and healthy usage patterns.

Your Account

To access most features of Jessalyn AI, you must create an account. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain the security of your password and account credentials; (c) promptly update your information if it changes; and (d) accept responsibility for all activity that occurs under your account. You may not share your account credentials with any other person, create multiple accounts, or create an account on behalf of someone else without their permission (except as provided for parental accounts). If you believe your account has been compromised, contact us immediately at support@jessalyn.ai. We reserve the right to suspend or terminate accounts that appear to be fraudulent, that violate these Terms, or that have been inactive for an extended period, in accordance with our data retention policies.

AI Transparency & Limitations

When you use Jessalyn AI, you are interacting with an artificial intelligence system, not a human being. Jessalyn uses large language model (LLM) technology to generate responses based on patterns learned from training data. It is important that you understand the following limitations: Jessalyn does not "know" you. While the App may reference previous conversations to provide continuity, the AI does not possess genuine understanding, empathy, or awareness. Responses are generated probabilistically and may not always be accurate, appropriate, or helpful. AI technology is still developing. Despite safety measures, Jessalyn may occasionally produce responses that are incorrect, incomplete, insensitive, or inconsistent. The AI may misunderstand your intent, fail to recognize important context, or provide suggestions that are not suitable for your specific situation. Jessalyn's responses should not be treated as professional advice of any kind — whether medical, psychological, legal, financial, or otherwise. The AI does not have access to your medical records, personal history, or any information beyond what you share in conversations. We continuously work to improve the safety and quality of AI responses, including through content filtering, safety guardrails, and ongoing evaluation. However, no AI system is perfect, and you should exercise your own judgment when considering any information or suggestions provided by the Service.

Subscriptions & Payments

Jessalyn AI may offer both free and paid subscription plans. If you choose a paid plan, the following terms apply: Billing. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan) through the Apple App Store, Google Play Store, or another authorized payment platform. The price of your subscription is displayed before purchase and may vary by region. Auto-Renewal. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel auto-renewal at any time through your device's subscription settings (Apple App Store or Google Play Store) or through the App. Price Changes. We reserve the right to change subscription prices. If we increase the price of your plan, we will notify you at least 30 days in advance. The new price will apply at your next renewal date. If you do not agree to the price change, you may cancel before the renewal date. Refunds. Refund eligibility is governed by the policies of the platform through which you purchased (Apple App Store or Google Play Store). We do not directly process refunds for purchases made through third-party platforms. For EU/EEA users, you may have a 14-day withdrawal right from the date of purchase, subject to applicable law. If a Minor User's parent or guardian is the billing party, the parent or guardian is responsible for all charges associated with the account.

User Content & Conduct

"User Content" refers to any text, voice messages, images, or other materials you submit through the Service, including your conversations with Jessalyn. You retain ownership of your User Content. By using the Service, you grant Jessalyn AI a limited, non-exclusive, worldwide, royalty-free license to use, process, and store your User Content solely for the purpose of providing, maintaining, and improving the Service. We will not use your conversation content for advertising, and we will not sell your User Content to third parties. You agree not to use the Service to: (a) violate any applicable law or regulation; (b) impersonate any person or entity; (c) attempt to reverse-engineer, decompile, or extract the source code of the AI or any part of the Service; (d) use automated means (bots, scrapers) to access the Service; (e) attempt to manipulate the AI into producing harmful, illegal, or explicit content; (f) share content that is abusive, threatening, defamatory, or that promotes violence or self-harm; (g) misrepresent your age; (h) share your account with others; or (i) use the Service for any purpose other than personal, non-commercial wellness support. We reserve the right to suspend or terminate accounts that violate these guidelines, with or without prior notice depending on the severity of the violation.

Intellectual Property

All content, features, functionality, and technology of the Jessalyn AI Service — including but not limited to the AI models, software, text, graphics, logos, icons, audio, design elements, and documentation — are the exclusive property of Jessalyn AI, Inc. or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes, subject to these Terms. This license does not include the right to: (a) modify, copy, or distribute any part of the Service; (b) use any data mining, robots, or similar data gathering tools; (c) create derivative works based on the Service; or (d) sublicense, sell, or transfer any rights granted to you. The "Jessalyn" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Jessalyn AI, Inc. You may not use such marks without our prior written permission.

Privacy & Data

Your privacy is critically important to us, especially given the sensitive nature of wellness conversations. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key privacy commitments reflected in our Privacy Policy include: We strip personally identifiable information before processing conversations through third-party AI models. We enforce zero data retention at the AI model provider level. We do not sell your personal information. We do not use your conversation data for advertising purposes. We provide clear mechanisms for you to access, export, and delete your data. Third-Party Services & Links

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by Jessalyn AI. This includes links to crisis helplines, app store pages, and external resources. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services. If you purchase a subscription through the Apple App Store or Google Play Store, your purchase is also subject to the terms and conditions of that platform. We are not a party to your agreement with Apple or Google.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JESSALYN AI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the AI responses will be accurate, reliable, complete, or appropriate for your situation; (c) any defects in the Service will be corrected; or (d) the Service will meet your specific requirements or expectations. No information or advice, whether oral or written, obtained from Jessalyn AI or through the Service shall create any warranty not expressly stated in these Terms. You acknowledge that your use of the Service is at your sole risk.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JESSALYN AI, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY CONTENT OR INFORMATION OBTAINED FROM THE SERVICE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (I) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED DOLLARS (USD $100). Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law. If you are a resident of the EU, EEA, or United Kingdom, nothing in these Terms affects your statutory rights as a consumer.

Dispute Resolution & Governing Law

Informal Resolution. Before filing any formal legal proceeding, you agree to attempt to resolve any dispute with us informally by contacting us at legal@jessalyn.ai. We will attempt to resolve the dispute within 30 days. If the dispute is not resolved within 30 days, either party may proceed as described below. Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in the English language, and judgment on the arbitration award may be entered in any court of competent jurisdiction. Class Action Waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND JESSALYN AI AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR JESSALYN AI WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, REPRESENTATIVE ACTION, OR PRIVATE ATTORNEY GENERAL ACTION. Opt-Out. You may opt out of the arbitration and class action waiver provisions by sending written notice to legal@jessalyn.ai within 30 days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you wish to opt out. Exceptions. Either party may bring a claim in small claims court if the claim qualifies. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Governing Law. These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. If the arbitration provision does not apply to you, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware.

Termination

You may stop using the Service at any time. You may delete your account through the App settings or by contacting support@jessalyn.ai. If you have an active subscription, canceling your account does not automatically cancel your subscription — you must also cancel your subscription through your device's subscription settings. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to: violation of these Terms, fraudulent or illegal activity, extended account inactivity, or if we determine that your needs exceed the scope of a wellness companion and require professional care. Parents and legal guardians of Minor Users may request account deletion on behalf of their child at any time by contacting support@jessalyn.ai. Upon termination, your right to use the Service ceases immediately. We will handle your data in accordance with our Privacy Policy, including honoring applicable data retention requirements and deletion requests. The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Dispute Resolution, and any other provisions that by their nature should survive.
